Terms of Service

These Terms are between you and Flint Harbor Technologies LLC for use of OutageBeacon, a product offered by Flint Harbor Technologies LLC.

1. Acceptance

By signing up for an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

We provide uptime monitoring, incident alerting, error tracking, heartbeats, public status pages, and related operational tools on a subscription or free-tier basis. We may modify, limit, suspend, or discontinue parts of the Service when needed to operate it safely or comply with law.

3. Your account

You are responsible for safeguarding your password, API tokens, project keys, webhook secrets, and other credentials. You are responsible for activity under your account unless caused by our breach of these Terms.

4. Acceptable use

Do not use the Service to monitor targets without authorization, send abusive traffic, collect data unlawfully, upload malware, interfere with other users, or violate applicable law. We may suspend or terminate accounts that abuse the Service or create operational risk.

5. Payment

Paid plans are billed through Stripe. Unless the checkout or invoice says otherwise, subscriptions renew automatically until canceled. You may cancel at any time, and cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods unless required by law or expressly stated at purchase.

6. Liability

The Service is provided "as is" and "as available" without warranties to the maximum extent allowed by law. We do not guarantee uninterrupted or error-free operation. We are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is capped at the greater of $100 or the amount you paid for the Service in the twelve months before the claim.

7. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these Terms, create security or operational risk, fail to pay amounts due, or use the Service unlawfully.
